OFFICIAL RULES AND REGULATIONS
1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. Latina & KODAK's Your Life in Pictures Contest (the "Contest") is open to all legal residents of the 50 United States and the District of Columbia, (excluding residents of Puerto Rico and other U.S. territories and possessions), 18 years of age or older. Void in Puerto Rico and U.S. territories and possessions and where prohibited by law. Employees of Sponsor (as defined below), and its affiliates, KODAK, and their respective parents, subsidiaries, affiliates, franchisees and advertising or promotion agencies (collectively, the "Promotional Partners") are not eligible to participate or win this Contest. Void wherever prohibited or restricted by law.
2. HOW TO ENTER: Between 12:01 AM (ET) on August 19, 2008 and 11:59 PM (ET) on December 31, 2008 (the "Promotional Period") (whereas Sponsor's computer is the official time-keeping device for the Contest), Sponsor will conduct a photo contest asking entrants to submit a photo of their choice ("Photo") and a brief story to accompany the photo describing "Why does your favorite photo means so much to you?" ("Topic"). To enter, participants must log on to the Contest page of the Latina.com website, located at http://www.latina.com/pictures (the "Website"), during the Promotional Period. All entrants must upload a typewritten, double-spaced essay of fifty (50) words or less in length (the "Story"), which focuses on the Topic described herein. Story and Photo must be the entrant's original, previously unpublished work and all entries (including Photo and Story) become the property of Sponsor, will not be acknowledged or returned and may be used by Sponsor in any manner or media in perpetuity without compensation. Story must be written in English and any plagiarism and/or failure to properly identify non-original material (Story or Photo) by an entrant will result in such entrant's disqualification. Any Story containing quotations or copyrighted materials which are not properly identified will also be disqualified. All words in the Story except the title shall be counted towards the word limit. Any Story or Photo that Sponsor and/or the judges deem, in their sole discretion, to be inappropriate or obscene will be void. Limit one (1) entry per person. Multiple entries from any person and/or duplicate entries will be deemed void.
No mechanical reproductions, or facsimiles will be accepted by Sponsor and all such entries will be void. Sponsor is not responsible for misdirected, inaccurate, incomplete, lost, late, delayed, undelivered, damaged or illegible entries, and all such entries will be void. Sponsor is also not responsible for technical, hardware, or software failures of any kind, or other errors or problems which may occur in connection with or relating to the Contest, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes, in any Contest-related materials or that may limit prize fulfillment or a participant's ability to enter the Contest. Sponsor reserves the right, in its sole discretion, to cancel, modify or prematurely conclude the Contest should any computer virus, malfunction, fraud, tampering, unauthorized intervention or other cause beyond their control corrupt the administration, security or proper operation of the Contest. If the Contest is cancelled, Sponsor may, in its sole discretion, judge all eligible entries received up to the time of such action using the judging procedures outlined below to determine the Winners. False or deceptive entries or acts will render the entrant ineligible and Sponsor reserves the right to disqualify any entrant (and void his/her entry) who attempts to undermine the legitimate operation of the Contest by tampering with any Website mechanism, acts in a disruptive manner or violates these Official Rules. Any attempt by an individual to deliberately damage or undermine the legitimate operation of the Contest may be in violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorneys' fees) from any such person(s) to the fullest extent of the law, including criminal prosecution.
3. JUDGING: Three (3) Winners will be selected by a panel of representatives from Sponsor and Promotional Partners on or about January 16, 2009 from all eligible entries received by the dates specified above, based equally upon the following criteria: originality, creativity, and overall eloquence. The decisions of the judges will be final and binding on all participants. The odds of being a Winner will depend on the total number of eligible entries received during the Promotional Period. The decisions of the Sponsor and judges will be final and binding on all matters.
4. WINNER NOTIFICATION: Potential Winners will be notified by Sponsor either by the telephone number or e-mail address provided on his/her Official Entry Form. Winners must also meet all eligibility requirements. Potential Winners may each be required to provide proof of identity, address and birth date, as well as execute and return an affidavit of eligibility, tax acknowledgment form, liability release and, except where prohibited by law, publicity release within ten (10) days of date of issuance either via facsimile or US certified mail in order to claim the prize. If any potential Winner fails to do so or if: (i) any prize notification is returned as undeliverable, (ii) a potential Winner declines his or her prize, or (iii) a potential Winner is determined to be ineligible for any reason, such potential Winner will be disqualified and, at Sponsor's sole discretion, a runner-up will be chosen.
5. PRIZES: Three (3) Winners will receive roundtrip airfare to Los Angeles, California; Hotel Accommodations in the Los Angeles area for two (2) nights; and an opportunity to have lunch with Nely Galan at a place to be determined in the Los Angeles area, on a date to be determined in February 2009. Approximate Retail Value ("ARV") of $2,000. Actual value may vary depending on city of departure. In the event winner resides within a 100 mile radius of Los Angeles, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. No substitutions, partial acceptance, transfer of prizes or cash redemptions permitted by Winners. Sponsor reserves the right to substitute a prize of comparable or greater value in the event a described prize or any portion thereof, is unavailable for any reason whatsoever. Winners are solely responsible for all expenses, costs or fees associated with acceptance and/or use of the prize not specifically stated herein as being awarded, including, but not limited to, any and all federal, state and local taxes, ground transportation, meals, gratuities, and souvenirs. All prize details are at Sponsor's sole discretion. If a winner cannot accept prize as stated, prize will be forfeited and, at Sponsor's discretion, an alternate winner selected.
6. GENERAL RULES AND REGULATIONS: By entering this Contest, entrants: (i) agree to be bound by the decisions of Sponsor and judges which are final and binding in all matters; (ii) grant Sponsor and their designees the right, unless prohibited by law, to use their names, cities and states of residence, voices, pictures and likenesses, without compensation, notification or permission, for the purpose of advertising and publicity in any and all media, now or after known, throughout the world in perpetuity; (iii) represent and warrant that they are not participating in the Contest (or, in the event they are a Winner) in the capacity of a reporter and further represent and warrant that they will not write, publish or cause to be published any article, work, or book about their participation; and (iv) acknowledge and agree that Sponsor will own and administer 100% of the copyright in all works submitted including but not limited to Story and Photo as defined herein), with the perpetual right to use such materials. Sponsor will own the entries submitted (and all rights embodied therein), and their designees may exploit, edit, modify, and distribute the entries and all elements of such entries, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media, now or hereafter known throughout the world in perpetuity without limitation at no additional notification or permission of entrants, or any third party. In addition, entrants forever waive and relinquish all so-called "moral rights" ("droit moral") now or hereafter recognized. Sponsor, expressly disclaims any responsibility and entrants agree to release, indemnify and hold Sponsor harmless for liability, damages or claims for injury or loss to any person or property (including death) relating to, in whole or in part, directly or indirectly, participation in this Contest, the acceptance and/or subsequent use or misuse of any of the prizes awarded (including any travel or activity release thereto), claims based on publicity rights, defamation or invasion of privacy. Sponsor is not responsible for any injury or damage to persons or property which may be caused directly or indirectly, in whole or in part, from the downloading of any material from the Website, regardless of whether the material was prepared by Sponsor or a third party, and regardless of whether the material is connected to the Website by a hypertext link.
