U.S. Supreme Court Justice Sonia Sotomayor challenged the anti-gay argument during the Prop 8 hearing yesterday. The Supreme Court could end up finding bans on same-sex marriage unconstitutional across the board. The Latina justice took her own stance on the matter during the hearing.

Excerpts of the proceedings have been released, and in them Sotomayor is quoted as swiftly shooting down the anti-gay marriage argument. She declared, "Outside of the marriage context, can you think of any other rational basis, reason, for a state using sexual orientation as a factor in denying homosexuals benefits or imposing burdens on them? Is there any other rational decision-making that the government could make? Denying them a job, not granting them benefits of some sort, any other decision?"

She ended up stumping Charles Cooper, the lawyer arguing against same-sex marriage, as he responded, “Your Honor, I cannot. I do not have any — anything to offer you in that regard.”
