Richard Rojas, the driver of the maroon 2009 Honda Accord, is in custody. According to Police Commissioner James O'Neill, the 26-year-old Bronx man was arrested twice, in 2008 and 2015, for drunken driving in New York.

"Right now, he is being transported to a testing facility where (officials) will test him for drugs and alcohol," Assistant Chief William Aubry added.

New York Mayor Bill de Blasio has spoken out on the accident, which occurred at noon, saying there is no indication that it was an act of terrorism.

“It was going at a fast rate of speed and to me it looked like it was trying to hit as many people as possible,” 24-year-old Annie Donahey, who had just left work when the vehicle sped past her and hit pedestrians on the sidewalk, told The New York Times. “People were trying to jump out of the way.”
