Gabriel Aubry isn’t giving up without a fight. Halle Berry’s ex claims in court documents that her fiancé Olivier Martinez shouted death threats at him during their Thanksgiving Day brawl.

Aubry states that he was visiting Halle’s house in the Hollywood Hills to visit his 4-year-old daughter Nahla. When he got to the door, the little girl said, “Olivier is here. I’m scared.” The model then allegedly approached the French actor and wanted to communicated peacefully, but Olivier attacked and threatened him by saying, "You cost us $3 million. When you see the judge, you're going to tell him you're going to Paris or I'm going to kill you.”

People reports that the allegations were made in an application for a restraining order against Olivier, which was granted by the court. However, a source tells the publication, "This incident arose as a result of a fight initiated by Mr. Aubry when Nahla was delivered for Thanksgiving and Mr. Martinez attempted to have a discussion with him.”

Regardless of the different versions of the story, there’s also a restraining order against Aubry to stay 100 yards away from Berry, Olivier, and the former couple’s child. Martinez has not commented on the incident.

What do you think about the dramatic situation?
